Fire Subrogation

Recovered more than $10 million on behalf of insurer in a fire loss that represented the largest personal lines loss in the history of the company.

Obtained a $3.3 million jury verdict in a Federal Court trial, involving a fire loss in Spokane, Washington.

Recovered nearly $4 million from a products manufacturer in a business fire loss.

Recovered more than $1.2 million following a successful trial of a fire loss caused by defective construction. Award included 100% of insurance payments made plus pre-judgment interest and attorneys’ fees.

Obtained $1 million recovery following a jury trial of fire loss caused by spontaneous combustion of construction materials during construction of a multimillion-dollar townhome/penthouse project.

Intellectual Property

Obtained a summary judgment in 2006 on behalf of a leading retailer in the U.S. District Court in New Hampshire. At issue was a six-year multimillion-dollar dispute over whether many of the company’s most popular product lines infringed on the plaintiff’s patented product design.

Complex Business Litigation

Successfully defended a manufacturer in a multi-week trial before a Federal Court jury against claims of misappropriation of trade secrets and design patent infringement.

Represented the uninsured creditors in the bankruptcy of an international general contractor.

Successfully resolved a multimillion-dollar dispute between business owners in a case involving allegations of fraud and accounting malfeasance.

Recovered nearly $2 million for an insurer in a dispute with an insurance broker.

Recovered $1.5 million on behalf of an insurer in a coverage dispute, in Atlanta.

Construction Litigation

Recovered more than $50 million on behalf of an owner/developer of a five-star hotel casino project in Las Vegas, Nevada. This case included multimillion-dollar delay, disruption and defective work claims against an international general contractor, subcontractors and design professionals.

Successfully represented a general contractor and surety in delay, defective work and wrongful termination claims, arising out of the construction of a municipal airport in Phoenix, Arizona.

Recovered virtually all bond payments made by a surety and obtained reversal from city contractor’s termination for cause, reinstating contractor’s bonding capacity.

Successfully represented an international architect in a dispute with the owner involving the expansion of one of the largest casinos in the United States.

Mr. Dallner is a civil trial attorney specializing in large, complex commercial litigation, with an emphasis on trials and appeals.  He represents companies and individuals across diverse industries in complex commercial, torts, and personal injury lawsuits. He has successfully litigated cases in State, Federal and Tribal courts throughout the United States, and he has recovered millions of dollars for his clients.

Representing clients in arbitration, trial and mediation throughout the United States, Mr. Dallner works closely with his clients to ensure that the matter is managed in a cost-effective manner, consistent with the client’s legal and business interests. His recent experience includes:

  • Part of a subrogation team litigating fire and water losses across the country involving construction defects, products liability, contract and general negligence claims.
